Responsibilities

  • Identify risks and emerging issues pertinent to the company's lending products and services in all states by keeping abreast of all related federal and state laws, regulations, rules and/or guidance and pending litigation; implement appropriate responses and controls to mitigate compliance risk to the company
  • Provide on-going assistance to business unit management in building compliance into the consumer lending processes, procedures, products and systems
  • Develop and review disclosures and agreements associated with the implementation of new products and services to ensure compliance with applicable federal and state laws and regulations. Perform testing to ensure that products and services implemented adhere with newly developed/ revised disclosures
  • Act as the compliance representative and provide compliance related guidance on assigned projects (i.e., new products/services, system conversions, due diligence reviews, acquisition teams)
  • Consumer complaint monitoring, tracking and resolution
  • Ensure the effective administration, implementation and enhancement of the company’s BSA/AML/OFAC/USA PATRIOT Act monitoring systems; CDD/EDD risk rating processes; suspicious activity investigation, monitoring and reporting; identity theft prevention and response
  • Review and test the company's compliance with applicable law; make recommendations as necessary to improve/enhance the company's compliance posture; and provide reporting on the company's compliance with applicable law
  • Assist the lines of business in implementing remedial action, including administering compliance training, for any compliance issues noted in conjunction with the compliance monitoring and perform periodic follow-up for outstanding compliance issues and assist in ensuring that management is rectifying any such issues
  • Assist the business areas with compliance related issues encountered during the development and implementation of new products and services
  • Review all policy/procedure updates implemented as a result of changes to products and services to ensure that they accurately reflect controls over compliance related functions
  • Provide guidance to compliance staff regarding the functionality of new/revised products and services to facilitate the review of any advertisements, as well as the execution of compliance monitoring reviews pertaining to new/revised products and services to ensure adherence with federal and state requirements
  • Participate in federal and state compliance examinations as the Compliance Officer and Fair Lending Officer. Performs special projects, and additional duties and responsibilities as required.

Qualifications

Bachelor's Degree required, preferably in Finance or Business. Juris Doctor a plus.  Relevant compliance certifications (CAMS, CFE, CRCM, lending compliance) are desirable. Five to 10 years relevant experience in Financial Services Industry or as a Regulator, with an emphasis on Consumer Lending compliance laws and regulations. Experience with Fair Lending requirements a plus.

  • Comprehensive understanding of BSA/AML/OFAC requirements and federal and state consumer lending laws and regulations (Truth in Lending Act – Reg. Z with an emphasis on closed end consumer credit, Equal Credit Opportunity Act – Reg. B, Fair Credit Reporting Act/FACT Act – Reg. V, Privacy of Consumer Financial Information – Reg. P, E-SIGN Act, Unfair, Deceptive, or Abusive Acts or Practices – Reg. AA, Servicemembers Civil Relief Act, Military Lending Act, Electronic Funds Transfer Act – Reg. E, Bank Secrecy Act, USA PATRIOT Act, OFAC SDN and Consolidated Sanctions Lists)
  • Advanced knowledge and understanding of consumer lending activities and related compliance functions
  • Articulate and communicate highly technical compliance-related information
  • Negotiate and collaborate with others, initiate action, adapt to change, make difficult decisions and accept challenging assignments
  • Excellent verbal and written communication skills
  • Strong leadership skills and the ability to supervise and provide direction to staff, delegate responsibilities appropriately and prioritize assignments
  • Excellent analytical and investigative capabilities and the ability to identify potential concerns and recommend operational improvements to management and initiate action
  • Refined organizational, project management and follow-up skills
  • Ability to work both independently and in a team-oriented environment
  • Proficient in Microsoft Office Suite, Salesforce, LexisNexis, United States Courts PACER/CMS EF
