Strategic Financial Solutions seeks an experienced Chief Compliance Officer and General Counsel (CCO-GC) to join our executive team to provide leadership, management and administration for the entire legal and compliance functions that support our business.

 

Strategic Financial Solutions has two main business lines: consumer debt relief and alternative consumer lending.

 

Managing a team of two compliance attorneys, three affiliated consumer debt attorneys and call quality and complaint tracking analysts, the CCO-GC will hit the ground running and be required to plan, manage and develop the team to support the exceptional growth of our business. With previous compliance and regulator experience in consumer debt markets, our new GC-CCO will help to hold us to the highest standards and stay ahead of any regulatory shifts.

This position will report directly to our CEO who shares a passion for diving into the details as well as stepping back out of the business to be strategic. Our new CCO-GC will become part of our Strategy Team and involved in major company decisions and strategic planning.  Regulatory requirements span a broad range of agencies including state-level banking and insurance regulators, FDIC, OCC, FTC and the CFPB. The CCO-GC will be responsible for managing the legal functions of the debt resolution and alternative consumer lending . As a result, the CCO-GC will manage our auditing process for consumer lending compliance and BSA/AML. Strategically, the CCO-GC will develop month, quarter, annual and long-term legal and compliance plans that will help us win and succeed. As the senior leader of a key shared resource, the CCO-GC will be a service provider to the rest of the organization and recognize that quality internal outcomes lead to client satisfaction and continued growth and profitability. The CCO-GC is expected to partner with key internal resources to execute on new initiatives to expand current capabilities and/or streamline existing processes.

Responsibilities

General

  • Manage the Compliance Department to ensure that the compliance program is maintained in a timely and efficient manner. Work with lending team each year to complete the Training Needs Analysis and maintain an Annual Training Plan. Develop, review and update internally designed training material, and oversee compliance training vendor
  • Manage compliance training program including oversight of audience assignment, communications, completion tracking, and management reporting
  • Administer and maintain the company’s internal department compliance manual to ensure timely updates and retention
  • Identifying areas of action to ensure the company is on track with solutions to any areas of concern, including enforcing internal company policy.
  • Plan and execute long-term compliance and regulatory strategies
  • Manage team of lawyers and compliance analysts in executing daily tasks for fulfillment of compliance and client goals
  • Monitor and track changes to state lending laws, regulations, rules, and guidance for relevant areas.
  • Research regulations by reviewing and monitoring regulatory bulletins and other sources of information including government websites such as the CFPB.
  • Manage compliance analyst team and report on client communications quality control including call and email monitoring as well as complaint tracking and management

Lending

  • Implement and monitor the internal compliance audit monitoring program for the consumer lending products to ensure regulatory reporting and documentation requirements are met. This position will also serve as the primary lead for all credit-related regulatory compliance:
    • Policies and procedures
    • Risk assessments
    • Implement new laws and regulations
    • Monitoring- fair lending, TILA, adverse notices, credit bureau reporting, data integrity, etc.
  • Maintain a strong working knowledge of federal laws and regulations applicable to banking and lender business activities
  • Work with bank charter partner and state regulatory agencies to enhance the execution of our business objectives 

Debt Resolution

  • Develop and manage training and communications program for attorney partners and their paralegal networks representing consumers in debt settlement
  • Develop and manage quality control systems regarding performance of attorney partners and their paralegal networks
  • Maintain a strong working knowledge of federal and state laws and regulations applicable to debt settlement business activities
  • Manage escalation and resolution of complaint
  • Work with industry association peers to advance the business objectives of the debt resolution industry

Tactical

  • Manage all legal and compliance resources and personnel for peak performance
  • Report results and partner with key operational areas for day-to-day successes
  • Documentation and plans to effectively communicate and support legal and compliance objectives and execution

Management

  • Plan, hire and develop all legal and compliance personnel; Reward success
  • Be an active coach to all operations/underwriting personnel
  • Become part of company culture and infuse that in the legal and compliance team
  • Partner with executive management for future advances and growth of the business with the ability to provide insights into legal/compliance issues
  • Develop, curate and execute the strategic legal/compliance roadmap

 

Qualifications

  • Juris Doctor Degree, or equivalent law degree
  • Admitted to practice in one or more states, New York admittance to be acquired
  • 10+ years Legal, Compliance and Management experience in high growth and/or dynamic environments with positive career progression and strong evidence of managing and developing teams and introducing and managing legal and compliance to improve business results
  • Fully knowledgeable of the lending process, laws and regulations, credit and risk assessment of the loan process.
  • Strong knowledge of federal regulations including Truth in Lending Act, Equal Credit Opportunity Act, Fair Credit Reporting Act and other related regulations preferred.
  • Experience establishing and implementing processes and procedures in a dynamic, growing company
  • Demonstrated organizational and project management skills
  • Experience developing and using key performance indicators to improve performance in a service delivery or operational setting
  • High energy and ability to work in a fast-paced environment

  • Strong PowerPoint and moderate Excel skills are required for analysis and presentations.
